Welcome to MindCareer. These Terms of Service ("Terms") govern your access to and use of the MindCareer website, mobile applications, and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Description of Service

MindCareer is a career guidance and mindfulness platform that provides:

• Personalized career assessments (Clarity Test)
• AI-powered career coaching conversations
• Guided mindfulness journeys for personal development
• Career insights and recommendations
• Tools for resume and LinkedIn optimization

3. Eligibility

You must be at least 16 years old to use MindCareer. By using the Service, you represent that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's consent to use the Service.

4. Account Registration

To access certain features, you may need to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

5. Subscription and Payments

5.1 Subscription Plans

MindCareer offers subscription plans (Monthly, Quarterly, and Yearly) that provide access to premium features. Prices are displayed on our website and are subject to change with notice.

5.2 Billing

Subscriptions are billed in advance on a recurring basis. You authorize us to charge your payment method automatically at each renewal period.

5.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

5.4 Refunds

6. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose
• Harass, abuse, or harm others through the Service
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the Service

• Impersonate any person or entity
• Use automated means to access the Service without permission
• Reverse engineer or attempt to extract source code
• Share your account credentials with others

7. AI Coaching Disclaimer

MindCareer's AI Coach is NOT a substitute for professional advice. Our AI-powered coaching:

• Provides general career guidance and mindfulness support
• Is NOT therapy, counseling, or mental health treatment
• Is NOT professional career counseling or job placement services
• Should NOT be used for urgent mental health concerns

If you are experiencing a mental health crisis, please contact a qualified mental health professional or crisis helpline immediately.

8. Intellectual Property

The Service, including all content, features, and functionality, is owned by MindCareer and protected by intellectual property laws.

Your Content: You retain ownership of content you submit. By submitting content, you grant us a non-exclusive, worldwide license to use, store, and process it to provide the Service.

Restrictions: You may not copy, modify, distribute, sell, or lease any part of our Service without permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be uninterrupted or error-free
• Warranties regarding the accuracy or reliability of results

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINDCAREER SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Damages resulting from your use of or inability to use the Service
• Any conduct or content of third parties

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless MindCareer, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination:

• Your right to use the Service immediately ceases
• We may delete your account and data (subject to our data retention policies)
• Provisions that should survive will remain in effect

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MindCareer operates, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through informal negotiation. If resolution cannot be reached within 30 days, disputes may be submitted to binding arbitration or the appropriate courts.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Service. Your continued use after changes constitutes acceptance of the new Terms.

16. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and MindCareer.
• Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
• Waiver: Our failure to enforce any right does not constitute a waiver.
• Assignment: You may not assign these Terms without our consent. We may assign our rights freely.
